1. Acceptance of Terms

By accessing or using OpenAtelier ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and OpenAtelier. We reserve the right to update these Terms at any time, and your continued use of the Service following any changes constitutes acceptance of those changes.

2. Description of Service

OpenAtelier is a writing platform designed for fiction authors. The Service provides manuscript editing, grimoire management, world-building tools, and a creative writing companion to support your creative process. We may introduce new features, modify existing functionality, or discontinue certain aspects of the Service at our discretion, with reasonable notice when practicable.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately of any unauthorized use of your account or any other breach of security.

4. User Content

You retain full ownership of all content you create, upload, or store through the Service, including but not limited to manuscripts, story notes, character profiles, world-building materials, and any other creative work ("User Content"). OpenAtelier does not claim any intellectual property rights over your User Content. You grant us only the limited, non-exclusive license necessary to provide the Service to you, such as storing and displaying your content within your account.

You are solely responsible for your User Content and represent that you have all necessary rights to the content you submit. We do not monitor, review, or edit your User Content, and we bear no responsibility for its accuracy, completeness, or legality.

5. Acceptable Use

You agree not to use the Service to: (a) violate any applicable law or regulation; (b) infringe upon the intellectual property rights of others; (c) upload or transmit malicious code, viruses, or any other harmful technology; (d) attempt to gain unauthorized access to other users' accounts or to the Service's infrastructure; (e) interfere with or disrupt the integrity or performance of the Service; or (f) use the Service for any purpose other than its intended use as a writing and creative tool.

6. Intellectual Property

The Service, including its original content, features, functionality, design, and underlying technology, is owned by OpenAtelier and is protected by copyright, trademark, and other intellectual property laws. Our trademarks, logos, and service marks may not be used in connection with any product or service without our prior written consent. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited license to use it in accordance with these Terms.

7. Termination

You may terminate your account at any time by contacting us or using the account deletion feature within the Service. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to allow you to export your User Content prior to account deletion. Any provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, OpenAtelier and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service. In no event shall our total liability to you for all claims arising from or relating to the Service exceed the amount you have paid us in the twelve months preceding the claim. This limitation of liability applies regardless of the theory of liability and even if we have been advised of the possibility of such damages.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically to stay informed of any updates.
